Asbestos analyst Mr Barrie Lyons has been fined by Greater Manchester Magistrates’ Court after it was ruled he falsified an asbestos air clearance certificate following licensed asbestos removal in Manchester. Mr Lyons was fines £2000 and ordered to pay costs of £3905.73.
Following asbestos removal at a construction site in central Manchester, Mr Lyons, who has over 29 years of experience, was hired to carry out a final inspection and air testing. This included a thorough examination of the area the asbestos had been removed from, the enclosure itself, and the surrounding areas, as well as the collection and evaluation of a number of air samples.
An investigation by the Health and Safety Executive identified that Mr Lyons had failed to conduct a thorough and acceptable inspection of the site and, contrary to the information in his report, had not carried out the correct amount of air sampling.
HSE ruled that this amounted to a deliberately falsified report, meaning that the published results were not reliable. As a result, the asbestos removal contractor had to arrange for a second clearance test to be carried out – causing them further delays and expense. What’s more, the falsified documents increased the risk of numerous people being exposed to potentially dangerous asbestos.
